The Town of Lebanon, Maine is currently accepting bid proposals for the removal of an office wall.  The wall measures approximately  10' x 12'.  Work area will be required to be sectioned off with plastic sheeting or similar material to limit dust throughout the Town Office.  
The following list of items need to be addressed in the bid proposal:

( This list is generalized and does not specify every detail of how to accomplish the job at hand, but rather generalizes the professional, industry standard project completion of the project which we require upon completion.)

* tear down/ removal of interior wall
* clean up and removal of all debris on daily basis required
* relocation of any affected electrical outlets and/or wires
* sheetrock/tape/mud/sand/paint all affected areas (walls & ceiling)
* replace carpeting in both affected offices with similar quality and color to the original, as close as possible. 

Sealed bids must include copies of all applicable insurances.  
Bids will be received to the attention of the Selectmen and delivered to 15 Upper Guinea Road, Lebanon, Maine, until  4:00PM on December 14, 2015.   Bids will then be turned over to the Selectmen Chair at which time the bids will be opened and publicly read at 4:30 pm on December 14, 2015.  
Bids meeting the specifications shall be considered.  The acceptable bid will be tentatively awarded the project after all bids have been opened, read aloud, and discussed.  
If any extenuating circumstances exist in the opinion of the Board, the Selectmen may award the Bid to other than the lowest bidder. 

The Board reserves the right to reject any or all bids.  

Contracted work must be done during regular business hours of the Town Office with as little interruption to the Town's normal work schedule as possible.   All work bids must be completed no later than February 2, 2016.  All bids must specify an estimated length of time for completion. 
 The project wall may be viewed during normal office hours upon request and accompaniment of a Town Office employee.

 The Town of Lebanon will receive sealed bids for grading dirt roads. This bid is for grading the roads three times from 10/01/2015 through 06/30/2016 at the discretion of the Road Commissioner. 
 All bids will must be received sealed by Thursday October 1st and will be opened publicly and read aloud on Thursday October 1st at 5:00pm at the Lebanon Town Hall. Bids will also be awarded on Thursday October 1st.

LEBANON MAINE SELECTMEN'S MEETING 9/10/15

 

Part 1 of the Lebanon Maine Board of Selectmen's meeting begins with Selectmen's Assistant Sue Collins addressing the Selectmen with the final few properties needing attention for the 2015-16 Tax Assessments.

Lebanon Maine Truth Seeker Deborah Dorey Wilson asks the Board if anyone has contacted J&S Masonry of Brownfield, Maine regarding their contract with the Town of Lebanon to keep many of the town's smaller cemeteries and Town properties mowed. No one has made the call even though it has been brought up in several meetings now. The job had been delegated to Selectman Heath, and he continually refuses to make one telephone call on behalf of the Residents of Lebanon.

Ms. Wilson also asks if anyone has heard from MIA Road Commissioner Tom Torno, and the answer is still that the Board has not contacted him about attending a Board of Selectmen's Meeting, a job that was delegated to Selectman Heath.

The Board discusses their plans for finalizing the Town's Tax Commitment during the early days of the week, perhaps Monday, September 14 or Tuesday, September 15.

In the second part of the 9/10/15 Selectmen's Meeting Video, Lebanon Maine Truth Seeker Sandy Adams addresses the Board with her concerns regarding Selectman Royce Heath's negligence in office. Ms. Adams questions any reprisal the Town residents might have if Selectman Heath continues to be negligent in his responsibilities as a Selectman. Sandy continues on, stating that so far this year, Selectman Heath has collected over $16K in salary and although he has performed the necessary measuring and property visits to finalize the Town's tax commitment, he has done little else besides continually refusing to comment, refusing to bring Road Commissioner Tom Torno before the Board of Selectmen, and refusing to contact the Town's private contractor in charge of mowing cemeteries and town properties.

When Ms. Adams asks Selectman Heath if he has anything to say for himself. The Selectman treats Sandy to a barrage of "NO COMMENT" statements before starting his famous paper shuffle and pretending that she is not speaking to him.

There is some discussion regarding the opening of bids, the 9/10/15 accident at the Town Office where a vehicle hit the front flower box causing very minor damage, and then Selectman Heath forgetting that he has to finish assessing before finalizing the Town's tax commitment.

Lebanon Maine Truth Seeker Deborah Dorey Wilson asks the Board if J&S Masonry will be paid the full $10,000 plus dollars of their contract even though they did not complete all the work in satisfactory manner, due to the fact that they have never been contacted regarding their insufficient work. Selectman Thompson states "Most Likely".

Ms. Wilson turns to Selectman Paul Nadeau and asks him if he will please take over the task of calling J&S Masonry, and after a brief conversation, Mr. Nadeau agrees to "call somebody" on Friday when he gets into the office.

There is discussion on a course that Town Clerk Mandy Grenier found that she thought the Board might be interested in having Animal Control Officer Mary Kinney attend, but after a brief discussion, it is said they will just ask if Mary would like to attend.

Selectmen's Assistant Collins returns to the meeting with a few additional assessment concerns.

Ms. Collins asks once again if the Board has considered her request to attend the Annual Maine Municipal Association in Augusta on September 16 and 17. Selectman Thompson tells her that the Board will be discussing it later on in the evening's meeting, but it is never revisited.

Lebanon Maine Truth Seeker Wilson asks the Board if there has ever been any discussion with the Road Commissioner regarding the concerns brought up in the Board's meeting of 8/31/15, by resident Chris Gilpatrick, regarding the fact that the Road Commissioner is paying a private contractor $55-$65 per hour for the use of a pick up truck with driver, and said pick up truck is being operated by a Town Employee who is on the clock for the town. Selectman Ben Thompson agrees that this is a problem that needs to be addressed, but there is no further discussion on when or how.

The Board discusses some wording options for the Festivals and Outdoor Events Permit Ordinance scheduled to be placed on the November 3 ballot by Town Clerk Mandy Grenier and Lebanon Code Enforcement Officer Mike Beaullieu. Discussed are issues on whether to use this permit ordinance to replace the current Mass Gathering Permit Ordinance (1981), whether time restrictions should be part of the ordinance or dealt with for individual permits, and whether or not noise restrictions should be part of the ordinance or whether a separate ordinance needs to be placed on the ballot creating verbage against late night noise.

As part of this discussion, Select Board Chairman Thompson reads aloud a complaint he has received only recently from a Lebanon resident regarding the late night noise "after the midnight hour" that is coming from Sky Dive New England on a constant basis. According to the Upper Guinea Road resident, the noise at Sky Dive New England is every weekend and includes, music, loud vehicles racing on the air strip, hooting and yelling, and fireworks. Thompson says that he thinks it is time for a noise control ordinance of some kind for the town, due to the fact that the Board is constantly having to "negotiate" between private parties due to noise problems.  Selectman Nadeau doesn't want to do anything with an ordinance at this time, stating that he'd rather wait for June 2016's Town Election as he "doesn't trust" a November election and that Town business  should be done in the Spring.

There was discussion on ordinances of the past, including a noise ordinance, that was on the Lebanon Ordinance Books in the past, but had been repealed years ago.

The Board ends the discussion on noise ordinance with no decision.

Part 3 of the Board of Selectmen's Meeting of Thursday, 9/10/15 shows a local woman, Ms. Mattingly present for the bid openings on the Sanding and Painting of the Exterior of the Lebanon Town Office. Ms. Mattingly works for Sherwin Williams paints and although she has no bid on the table herself, she is present just to offer any advice that she can to the Board and observe the opening of the bids.  Three bids have been received for the Sanding and Painting bid, listed in the order they were opened......

 

1. A&J Services (Sanford, ME) offers a bid for hand painting, no spraying, using Sherwin Williams paints, in the amount of $3,675.00

2. Sunrise Over Cedars Property Maintenance Services LLC (Acton, ME) offers a bid for spraying of $7,082.00

3. Pete's Precision Painting (Sanford, ME) offers a very detailed bid using the spraying method of paint and stain in the amount of $6,355.00

 

There is discussion regarding the differences in paints and the difference in application methods between hand painting and spraying. Ms. Mattingly is very helpful to the Board with her knowledge.

The Board awards the bid for Sanding and Painting of the Exterior of the Lebanon Maine Town Office Building to Pete's Precision Painting.

Selectman Heath made the motion, seconded by Selectman Nadeau. 3 in favor, 0 opposed.

The fourth part of the Video of the Board of Selectmen's Meeting of 9/10/15 shows Select Board Chairman Ben Thompson opening the folder for the Electrical Services Bid for testing and maintaining the Town's emergency generators, among other things. Everyone is surprised that although this has been bid twice, there are no bids to perform this service.

Discussion is made by Selectman Heath on utilizing the services of Selectman Nadeau's nephew for these services.

Part 5 of the Thursday, September 10, 2015 Board of Selectmen's Meeting shows the opening of the Winter Sand Supply and Delivery Bid. There has only been one bid received, and it is from STS Construction (Lebanon, ME) in the amount of $8.23 per cubic yard.

All Board members agree that STS has done a fine job of providing Winter Sand for the Town and the bid is awarded to STS Construction.

Part 6 of the 9/10/15 Board of Selectmen's Meeting Video shows Selectman Heath motioning to accept the bid of STS Construction for the Supply and Delivery of Winter Sand to the Town of Lebanon. Selectman Nadeau seconds the motion. 3 in favor, 0 opposed.

The Board moves on to a final folder containing a bid for the Town's request for proposal for bids on Roadside Mowing. There are no bids for these services.

There is a final folder in the bid opening stack, and it is for Town of Lebanon Road Grading. The folder includes 1 bid from R. D. Torno and Sons Paving, Inc.  The amount of the bid by Torno and sons is not disclosed. There is discussion as to whether this bid was ever published to promote competitive pricing and it does not seem that Road Commissioner Torno ever published such a Bid Request as the process requires, so Select Board Chairman Thompson moves that the bid be disregarded. Selectman Nadeau seconds the motion and the Board votes 2 in favor with Selectman Heath abstaining.

The seventh and final portion of the 9/10/15 Lebanon Maine Board of Selectmen's Meeting video shows the Board as they prepare to leave the building to go and assess the final few remaining properties for the year prior to the beginning of the Lebanon Budget Committee Meeting which was scheduled to begin at 7 pm.

Board Chairman Ben Thompson provides Selectman Heath the option to read the minutes from the previous Board Meeting as scribed and provided by Lebanon Maine Truth Seeker Sandy Adams. Although both Thompson and Nadeau have gone over the minutes and approved them as public documents, Selectman Heath refuses the option to review them.

Lebanon Maine Truth Seeker Deborah Dorey Wilson questions Mr. Heath regarding the June - August 2015 Meeting Minutes for which the Selectman was responsible for taking and transcribing. Select Board Chairman Thompson states that neither formal minutes, nor draft copies have ever been turned in by Selectman Heath, but that he had requested Selectman Heath to provide him with at least the draft copies of said public documents by that evening.

Selectman Heath states that there is no law stating that any Board be required to take minutes of any meeting, and in face value, he is correct. However, once minutes are created in any form (draft or final) during a public meeting, they become the property of the public that the agency serves. (In this case, the Town of Lebanon and it's taxpayers).

 

HERE is the LAW......

Who enforces the Freedom of Access Act?Any aggrieved person may appeal to any Superior Court in the state to seek relief for an alleged violation of the FOAA. 1 M.R.S. § 409(1) Relief can be in the form of an order issued by the court that directs the government body, agency or official to comply with the law, such as by providing access to a public proceeding or by making public records available for inspection or copying. In addition, the Office of the Attorney General or the District Attorneys may bring an enforcement action seeking penalties if the alleged violation is willful. 1 M.R.S. § 410

What are the penalties for failure to comply with the Freedom of Access Act? A state government agency or local government entity whose officer or employee commits a willful violation of the FOAA commits a civil violation for which a forfeiture of not more than $500 may be adjudged. 1 M.R.S. § 410 Under the current law, there are no criminal penalties for failure to comply with a request for public records. It is a Class D crime to intentionally remove, alter, or destroy documents belonging to a state office. 1 M.R.S. § 452

Chairman Thompson reminds Selectman Heath that while it is true that no Board is required to take such minutes, once the minutes have been created, even in draft copy, they are considered public documents and therefore must be kept in the Town Office for review.

 

Discussion is held regarding the town's tax commitment to be set on Monday, September 14, 2015.

BOARD OF SELECTMEN

The first person on the agenda for the Board of Selectmen's meeting on Monday evening 8/17/15 was Road Commissioner Tom Torno. The Board has had Mr. Torno on their agenda several times in the past few weeks without him actually coming in, so we were glad to see him come in!!

Torno discusses with the Board some upcoming bids he will be putting out for supply of sand and supply of salt, he presents his Road Plowing Contract (for use with Independent Plowing Contractors) for the upcoming Winter ( 2015-2016) and explains a few changes that have been made.

Road Commissioner Torno says that Mrs. Abbott approached him and has a tow behind street sweeping unit that she would like to donate to the town for their use. 

There are a few dead tree branches hanging precariously over the back roads of Lebanon and Tom says that he is going to call and have them removed. Selectman Heath also identifies a utility pole that is in need of some attention. Torno says that he has had a problem getting CMP to respond to his calls regarding this issue, but he will continue to call. There have also been multiple calls made trying to get some stone for finishing a few projects in town. It seems everyone is busy this season!

Ditching has been completed on Center Road down near the Henderson's.

Lebanon Maine Truth Seekers Deborah Wilson asks Mr. Torno if he's had the time to go over his 2014-2015 budget and figure out where the discrepancy is. Torno had previously claimed that there is about a $9,000 difference in what he thought was there and what year end budget reports claim was there. At Monday evening's meeting, he stated that he had been too busy and hadn't had time yet to go over the numbers.

Ms. Wilson also asked Mr. Torno about his newly hired Road Crew member working at the Lebanon Transfer Station on Saturday, August 8, 2015. Mr. Torno stated that he had nothing to do with that and has no idea how that happened. When questioned as to why his worker would have needed more hours in the week and why he would have hired someone if he didn't have the hours to keep them busy, Road Commissioner Torno stated that he had given his new employee 30 hours already that week, anything at the Town Transfer Station was in addition to his already full time card. Mr. Torno stated that he had "No Clue" as to who had called his employee, how they knew his number, or how they could just call his man to the Transfer Station.

At this time, Mr. Nadeau spoke up and said "We're changing that," continuing on to say that the policy of calling random workers into the Transfer Station was how the Department had acquired Royce Heath as an employee. Nadeau also stated that it would not happen again.

The second part of the 8/17/15 Meeting video may get a little stale for the average viewer, but for those of us trying to understand the scope of work needed in assessing a town's property tax values, this section is helpful. Selectmen's Assistant, Sue Collins, comes in to speak with the Board on their assessment of mobile homes on Saturday, 8/15. It's interesting that there are several changes on properties that don't seem to be on the last assessment but that don't seem to have had building permits, however, over the years, Code Enforcement seems to have been spotty at best.

Lebanon Maine Truth Seekers Deborah Wilson asks the Board for help with a question she received from 2 residents of Evergreen Trailer Park on Rt. 202. The question is in regards to a resident there who is building a large closed in addition to his mobile home without building permits. The third part of the Selectmen's Meeting Video, Lebanon Code Enforcement Officer comes in for a brief chat with Selectmen regarding a tenant vs landlord complaint in town. The Board and CEO are both questioning how much involvement he can have in ending the dispute. Code violations may be at play here, but they're not sure until Beaulieu goes out and has a look. Selectman Thompson explains that this may be a civil issue that needs to be acted upon by the courts rather than the Board.

There is discussion on a course Mr. Beaulieu would like to take which includes solutions on just this type of issue. The Board is taking that course under advisement.

A brief session with Town Treasurer Jeanette Lemay regarding the Board's closing on the TAN (tax anticipated note) for $1 Million dollars which is scheduled to take place Tuesday 8/18/15.

Representative from F.R. Carroll company, Tim Benton, arrives to observe the Bid Opening for Bituminous Paving products scheduled for 5 pm.

Town Clerk Mandy Grenier arrives carrying the sealed bids for Bituminous Paving and for IT Services. She states that the Town received no bids for their Sanding and Painting bid request, and none for their Electrical Services bid request.

Part 5 of Monday evening, 8/17/15 Selectmen's Meeting Video shows Select Board Chairman Ben Thompson as he opens the bids received for the town's Bituminous Paving bid request and the IT Service bid Request.

Mr. Tim Benton of F.R. Carroll, Inc of Limerick, Maine is present for the opening. His company bid for $62.45 per ton supply of machine applied hot mix asphalt and $100 per ton for labor. 

Also submitting bids without representatives present were:

Pike Industries, from Belmont NH who submitted several prices including $91.00 per ton hot mix asphalt, machine applied.... $10 per ton hot mix asphalt hand placed....and $2.65 per ton Reclaimed and fine grade.

R.D. Torno & Sons Paving from Lebanon Maine rounded out the trio of bidders with a bid price of $71.80 per ton for machine applied hot mix asphalt and $135 per ton labor.

 

The second bid opening was for that of IT Services to the Town. It has been identified that Lebanon is in huge need of upgrades in technology, security and storage capability. It was confusing, at best to watch these bids being opened due to the fact that none of the 5 companies bidding seemed to be bidding on the same thing.

The Board goes into Executive Session with Town Clerk Mandy Grenier to interview 3 people being considered for the Collector / Deputy Clerk position open at the Town Office.

The sixth and final section of the Board of Selectmen's Video shows the Board discussion their meeting on Thursday with a resident asking the Board, as assessors, to take a second look at his home as the Real Estate valuation was lower than the assessed value by about $50,000. The Board has been to look at the home.

The Board talks briefly about the 8/18/15 closing on the TAN through Kennebunk Savings Bank. Thompson reveals that after paying AP on 8/17/15, the town still has $714,469.31 in their account, which Thompson says he is pleased with that amount.

Although the Board can not adjourn the meeting due to remaining work, Selectman Nadeau leaves for the evening before the meeting is adjourned.

Lebanon Maine Truth Seekers requests that she have time for questions. Selectman Heath does not want to answer any questions, and Wilson says she will wait for her chance after he is finished for the evening.

Selectmen Heath and Thompson give Wilson 3 minutes.

Wilson is questioning how the Road Crew member wound up working at the Transfer Station on Saturday, 8/ 8/15. Thompson says he would also like to know, but Selectman Heath does not disappoint with his "NO COMMENT" answer.

Selectman Thompson says that he would like to know, but cannot go outside the scope of the Board. He could personally ask Transfer Station Manager Ronal Patch, however that would not be an "on the record" conversation.

Wilson assured Select Board Chairman Thompson that she will call Mr. Patch in the morning and see what happened that caused 2 Selectmen and a Road Crew member to be working at the Transfer Station on Saturday 8/8/15 while Manager Patch and his family were all out of town.

Selectman Thompson says that Nadeau has stated "It won't happen again," but that if it does, it will become a problem.

The Board continued processing Accounts Payable for quite a while before adjourning for the evening.

The first part of the video from the Lebanon Maine Board of Selectmen shows the Board speaking about the upcoming Medical Marijuana Festival scheduled for Friday, August 21 - Sunday August 23, 2015. The Festival has requested a midnight end time on Friday night, 1 in the morning on Saturday, and 9 pm on Sunday. The Board is thinking that those times may be a little late for the Festivals neighbors. According to Selectman Thompson, the Festival is expecting over 1,000 visitors this year.

Some discussion is had regarding the heat in the Selectmen's Office and the hope that voters in November will allow for the Selectmen to spend some money from the town's Contingency Fund in order to open the wall between their current meeting room and the current Code Enforcement Office to make a larger meeting room. The Lebanon Maine Truth Seekers purchased and donated a window fan to the Board over a month ago, in hopes of improving temperature and air quality in the room, however, only minutes after turning it on, Selectman Nadeau stated he couldn't hear over the fan and it has sat, unused, under the Selectmen's desk, since the day of it's donation.

Lebanon Board welcomes Colby, a member of Lebanon Boy Scout Troop 369, who is at the meeting in order to observe and gather information for his Citizenship and Community Badge.

The Board speaks with Treasurer Jeanette Lemay regarding the town's upcoming bid for Information  Technology (hereafter IT) assistance, which should be ready for publication on Friday, July 31st, 2015. It is Lemay's goal to bring the town's computer system into modern times, with the ability to "talk" between town departments. Specifically she mentions Fire, EMS, Highway Departments.

The third part of the Thursday, July 30th Lebanon Maine Selectmen's Meeting video shows Lebanon Maine Truth Seeker Deborah Dorey Wilson asking a resident's question regarding the publication (or lack thereof) of Selectmen's Meeting Minutes to the Town's Website. According to the resident who had asked, the June 8th meeting, and all those that have occurred since that time, are not published. Selectman Royce Heath, who is the designated Secretary for the trio erupts in a series of "NO COMMENT" answers to both Wilson and Lebanon Maine Truth Seeker Sandy Adams' questions. Selectman Nadeau is asked for comment, to which he replies "NOPE" and Select Board Chairman Thompson says that he would LIKE to see the minutes continue to be posted, however they are not in his possession. Selectman Heath does state that they are in his possession, but then continues on with the "NO COMMENT" comments.

The fourth and final part of the Lebanon Maine Selectmen's Meeting Video begins with a conference call to Maine State Police Sergeant Shapiro in regards to the upcoming Events and Festivals coming up in town including the Medical Marijuana Festival, Tiki Days at Skydive New England, Country Music Festival at the 4X4 Proving Ground and more......

The upcoming Re-Dedication Ceremony for the Gully Oven Town Park is discussed, and none of the Board had any idea that it was happening, and at first look, had no intention of attending. No answer was ever given in surety if they are intending on attending now that they are aware.

Lebanon Code Enforcement Officer Mike Beaulieu speaks to the Board on his work on the pending Festivals and Mass Gathering Permits. He speaks about placing his office hours on the window of the Code Enforcement Office door.......Monday and Tuesday from 7 am to 12 noon and "Available for Inspections" noon to 5 pm by appointment only.

Beaulieu states that the town has received $4,678.00 in building and plumbing permits during the month of July and says this money is from permitting for 8 new buildings. He says that Rockwell Homes is planning a total of 30 new Lebanon Homes in the upcoming year.

Town Clerk Mandy Grenier speaks to the Board on her research and development of ordinances to require Business Licensing within the town, including permanent businesses, Festivals and Gatherings. Ms. Grenier and Mike Beaulieu have been working together to create some very good ordinance and fee structures for proposals which will be presented at a Town Meeting (date to be determined) and then placed on the November ballot.

Ms. Grenier takes a moment to explain the need for Business Licensing as Lebanon continues to grow, with words on how part of the higher tax rate in Lebanon is due to the increase of Town services for businesses and their need to pay for those services rather than the expenses being shifted to the residential taxpayers in town. The Town Clerk also speaks about the importance of the townspeople's attendance at Town Meetings, and how she feels compelled to send multiple notices and try to increase taxpayer attendance and participation at the meetings.

Selectmen Heath and Nadeau both spend their time telling her reasons why they don't think it will work and giving their opinion that she will never get more than 60 people at a town meeting.

Undaunted, Ms. Grenier asks the Board to look over the proposed changes in the Mass Gathering Application she and Mr. Beaulieu have prepared, which does not need a town vote to be changed, and the pair think that their form of Application will make things easier on gathering hosts to know the rules, know what's expected of them, and understand the fees associated with the permitting process.

Ms. Grenier then asks the Board to schedule time to review the 7-10 Applications for the Part time Deputy Clerk / Collector position that she has open for the Town Office. It is decided that she will sit with the Board to discuss these, and any that come in until that date, on August 13th at 4:30 pm.

At the end of the discussion, Lebanon Truth Seeker Deborah Dorey Wilson asks for public participation time and is granted one minute. Wilson takes her allotted time to speak to the Town Clerk, thanking her for her hard work, research and preparation of the Business Licensing Permit Ordinance proposals, with Selectman Heath interjecting that 1 minute Public Participation time is over after only 21 seconds. Wilson continues to speak with Selectman Nadeau regarding discouraging such a refreshing work ethic and reminding him that Lebanon is changing whether we like it or not and proper knowledge of businesses operating in town is important. Selectman Heath motions to close the meeting during the discussion.

Lebanon Board of Selectmen's Meeting Video from July 27th, 2015

 

The Lebanon Maine Board of Selectmen held their normal Monday evening meeting beginning at 4 pm on 7/27/15.

Conversations are held regarding a meeting at Acton's Blueberry Hill Farm regarding outdoor events held, and a letter for the Board to attend. Since the Town owns property that abuts the Farm, they have been notified of the meeting.

Discussion and paperwork shuffled regarding the changing of the Lebanon Town Voting day to correspond with MSAD60's Annual Budget approving vote.

Select Board Chairman Ben Thompson hands out for review, a motion for a new Town Policy which will limit Public Participation at Select Board Meetings.

Road Commissioner Tom Torno arrives at the meeting presenting an application for a Road Crew Laborer to the town, that they later consider and approve for hire.

Road Commissioner Torno presents an application for L-Rap money. We're still not completely sure of who this application goes to and what the parameters of the money or materials are, but we have a call in to Mr. Torno asking just that question. We'll update when we receive more information.

Torno states that the Bid Proposals are ready to be published for Lebanon roadside mowing and for Paving of the town's roadways.

There is discussion regarding replacing of the guardrail over the bridge on Fall Road where an accident occurred last week.

Commissioner Torno discusses Road Grading for Godding Road, Lower Barley, and Lower Guinea Road, mentioning that there are a few others that need it as well. Select Board Chairman Thompson advises Torno to put the work out for bid.

Discussion of Orrill's Hill Road, which involves former Selectman Ronal Patch.

Winter must be fast approaching, as Torno states that he is getting calls regarding snow plow work in the town. Discussion is held on how well the contracts worked last year making each private contractor responsible for a certain section of town. This will be done again for the 2015-16 Winter.

The Board discusses with the Road Commissioner the need for No Parking signs for the upcoming Medical Marijuana Festival (August 21-23) on Center Road.

Lebanon Maine Truth Seekers' Deborah Wilson asks Mr. Torno about the overage in his budget of about $7,000.00. Torno says he was surprised by that number and is continuing to go over his expenditures. He states that he had been keeping track of moneys spent and then suddenly, in the last month of the year, about $9,000 came out of his budget that he can not account for. He has promised to continue to look into the financials and let us know.

Note Select Board Chairman Thompson trying to limit my conversation on this matter, BEFORE his Public Participation Limits Motion has been approved and voted on by the Board.

After Commissioner Torno and I are finished speaking, Thompson announces the Board is going into Executive Session with former Selectman Paul Philbrick. No notice is made on what the topic of discussion is for this Executive Session.

Part 2 of the July 27th, 2015 Lebanon Maine Selectmen's Meeting show's Select Board Chairman Ben Thompson effectively presenting a new Public Participation Policy for the Board of Selectmen's Meetings, effectively stripping away Residents' First Amendment Rights to Freedom of Speech. Thompson's motion comes as no surprise as the Board has been increasingly frustrated by the public questions regarding the Board's Ethics and Responsibilities, apparently there has been some kind of discussion by the Board Members outside of the Public Meeting regarding this Policy as Selectman Nadeau is ready to second the motion before it's even been made.

So now, if you would like to speak or ask questions during the Selectmen's Meetings, the Board has deemed that you must wait until the end of the Agenda item to do so, AND you will be given ONLY between 1 and 5 minutes (that's actually up to the Board once they decide if they like what you're speaking about). AND if your questions run over the allotted amount given to you by Selectmen, you have to give a 2 day notice to be included on the Agenda for the next Board Meeting. This is very interesting as there are never any Agenda's published on time (2 days prior) for ANY Board of Selectmen's Meeting, and by the time you get into the Board Meeting, the Agenda is usually changed to include, or exclude Agenda items, IF they've bothered to post them at all.

IF the Board is going to require people with questions to give 2 days notice, ALL scheduled Agenda items should require a 2 day notice AND the Agenda should be published at the end of that 2 day period. When this is brought up, the Chairman agrees that Agenda's should be published in a timely fashion, but no motion is on the table to change that policy, only the policy that will effectively stop the public from asking questions during a meeting.

REVIEW this new Selctmen's Meeting Public Participation Policy HERE:

 

 

CAN the Selectmen stop you from speaking at a Board of Selectmen's Meeting? YES, they can. It's also a provision by Maine State Law that Public Meetings don't always have to include time for public commentary, so they are well within their rights to limit the time allotted for questions or conversation. While the practice in New England is typically to give defined periods of time for public participation to each item identified on the Board Agenda for the evening, the Board is under no obligation to do so. However, if they stop one person from speaking, the practice MUST pertain to all people in the town. The Policy provided by Select Board Chairman Thompson for "up to 5 minutes" can bring the Board a lot of problems. Thompson's statement that HE (as the Board Chair), be allowed to decide if the Board will grant LESS than 5 minutes to a single individual could be argued in a court, should a resident's rights be shortened or terminated by the Board Chairman.

We will be watching the outcome of a pending law suit by that New Hampshire citizen in his rights being denied as it progresses through the court system.

 

The end of this part of the Selectmen's Meeting Video shows Thompson speaking regarding the Zoll Heart Monitor carried on Ambulance 2 for the Lebanon Fire and EMS Department. The Heart monitor is the newer of the 2 machines owned by the Department, and it was damaged by water during the hail and rain that Lebanon experienced last week, when the Department had to use it during a water rescue when a vehicle left the pavement on Fall Road last week and went down into the water. The Department was questioning whether or not the machine was covered under town insurance policies, and according to Thompson, it is. Chief Meehan will now look into replacing or repairing the damaged monitor, and for now, Ambulance 2 (our newer vehicle) will be carrying the older of the 2 heart monitors.

The third part of the July 27th, 2015 Lebanon Board of Selectmen's Meeting video is only a short clip. Lebanon Maine Truth Seeker Sandy Adams and her son have been weeding and cleaning the garden area in front of the Lebanon Town Office. Adams had asked Selectmen over a week ago to get a few bags of mulch for the garden, so that it could be put down once the work had been completed. Adams asks the Board if they are ready to supply the mulch as she and her son plan to finish up the work on the garden this coming Saturday. But Select Board Chairman Thompson can't seem to commit to a few bags of mulch, saying he's doubtful it can be provided by the weekend (5 days from today's date). Does anyone have any extra mulch laying around they could provide to make our Town Office a beautiful place?

The fourth part of the July 27th Lebanon Board of Selectmen's Meeting shows Board Chairman Ben Thompson reading a letter that the Board will be sending to the Milton NH Board of Selectmen and the Milton NH Fire and Rescue Chief thanking them for reconsidering the fee they associated with Mutual Aid responses in Lebanon and for erasing the debt of $4,000 they held for past responses. The letter, follows in direct response to the written notice of said release of debt from Milton Fire and Rescue Chief Nick Marique dated July 7th, 2015.

Board Member Royce Heath has questions as to whether or not the Board should be penning letters to other municipalities who have also erased their charges, and debts, against Lebanon following the hiring of Chief Daniel Meehan, and the work he has done to sure up the relationships between Mutual Aid towns. "There have been a lot of people who have helped us out," stated Heath.

Thompson's response is that he has only received verbal confirmation of those debt releases, and is waiting for written confirmation prior to sending out written letters of thanks to other towns, cities, and organizations.

 

Lebanon Maine Truth Seekers takes a moment of the Board's time to ask whether or not the Town Ethics Policy provided for the Board's consideration over a month ago, by Chairman Thompson had been discussed or considered. Thompson holds up a folder and answers that "It's in there to be discussed," but only when questioned on WHEN, does the Board decide they will visit the Policy and discuss it after Selectman Heath returns to the Board from his scheduled Assessment Classes. That POSSIBLY hold them to discussing the matter on the 2nd week of August, 2015.

 

The Board enters into Executive Session again, this time to consider 2 Confidential Records (employment applications) and 1 Personnel issue. Transfer Station Ronal Patch is included in the Executive Session discussions.

The final portion of the  July 27th Lebanon Maine Selectmen's Meeting video shows the Board passing a motion to allow Select Board Chairman Ben Thompson to "investigate" the issue they've been discussing regarding a Town Employee. Selectman Paul Nadeau, already finished with his portion of the Town's Payroll commitment leaves the meeting, even though it has not yet been adjourned, while Selectmen Heath and Thompson stay to complete payroll obligations.
